Règlement Jeu Concours Kids

The following Terms and Conditions (the “Terms”) apply to the #FOREVERKIDS (the “Prize Draw”). By accessing, entering into and/or using the Prize Draw, entrants (the “Entrants”) understand and agree to be bound by the Terms, and to comply with all applicable laws and regulations. All entry instructions form part of the Terms.

1. General

1.1. The promoter of this Prize Draw (the “Promoter”) is Aigle International S.A, a limited company duly organised and existing under the laws of France.

1.2. Words denoting the singular number shall include the plural number and vice versa, words denoting the masculine gender shall include the feminine gender, words denoting persons shall include corporations, partnerships and other corporate entities.

1.3. Entrants hereby certify that they are over eighteen (18) years of age and legally competent and duly authorized to use the Prize Draw.

1.4. Entrants undertake not to use the Prize Draw for any purpose that is unlawful or prohibited by these Terms nor in any manner that could damage, disable, overburden, or impair any server, or the network(s) connected to any Promoter’s server, or interfere with any other party's use and enjoyment of the Prize Draw.

1.5. The Promoter reserves the right to amend the Terms and/or cancel the Prize Draw in whole or in part at its sole discretion.

2. Functioning of the Prize Draw

2.1. The Prize Draw opens on September 4th, 2021 (the “Opening Date”) and closes at midnight on Septeber 14th, 2021 (the “Closing Date”). No entries shall be accepted before the Opening Date or after the Closing Date. Entries are limited to one (1) entry per household. Entries not in accordance with the Terms and entry instructions are invalid. The Prize Draw is open through the Promoter’s Instagram at https://intagram.com/aigle?igshid=1c1o86p8nwf4 and Promoter’s Twitter at https://twitter.com/aiglefr.

2.2. The Prize Draw is open to persons aged eighteen (18) or over, who are residents of the European Union and United Kingdom, Isle of Man and Channel Islands. The Promoter accepts no responsibility for entries that are misdirected, lost, stolen, delayed, damaged or corrupted due to any computer

malfunction, virus, bug, delay or other reason whatsoever. The Prize Draw is specifically closed to employees of the Promoter, any associated companies, their families and anyone professionally involved in the Prize Draw.

2.3. NO PURCHASE OF ANY KIND IS NECESSARY TO TAKE PART IN THIS PRIZE DRAW. Entrants do not have to buy any product in order to enter this Prize Draw.

2.4. Entrants should subscribe to Aigle's Instagram or Aigle’s Twitter, publish a drawing of their children, then share the drawing in their Instagram story or in Twitter post and tag @Aigle with the #FOREVERKIDS. Entrants will need to have a public Instagram account when they share their drawing.

2.5. The Prize Draw will be made on September 15th, 2021 by an independent person and the Promoter’s decision is final. The Winners for the Prizes will be drawn at random from all entries received on Instagram and Twitter. No correspondence will be entered into.

2.6. Five Entrants will be drawn the Prize Draw (the “Winners”) and will receive one (1) children's Jacket and one (1) a pair of children's rubber boot (hereinafter the “Jacket”) of their choice. The Winners can choose the size and color of the Prize, as long as stocks last.

2.7. The Winners will be contacted by private message on Instagram or Twitter by September 15th, 2021. The Winners agrees that the Promoter can use the contact details the Winner has entered at the time of participating to the Prize Draw to inform the Winner. When the Promoter notifies a Winner by Instagram or Twitter private message, the Winners must provide confirmation of receipt by a reply private message no later than September 30th, 2021. If the Winners cannot be contacted by Instagram or Twitter private message by 12p.m. on September 16th, 2021 the Promoter reserves the right to select another winner at random from the remaining eligible entries and thereafter until a confirmed winner is found.

3. Special Provisions and Liability

3.1. Except for the Promoter's obligations towards the Winners as set forth herein, the Promoter shall not have any liability or bear any responsibility to third party using the Prize Draw.

3.2. The Prize may be altered or varied at the Promoter’s sole discretion and substituted with a prize which, in the Promoter’s sole opinion, is a suitable alternative. No cash alternatives are available. The Prize are non-transferable and may not be sold, offered for sale, coupled or bundled with any other product or services or used for any commercial or promotional purposes whatsoever.

3.3. All information submitted to the Promoter as part of this Prize Draw will be treated in accordance with the Promoter’s Privacy Policy. The personal data that Entrants provide will be held and processed in accordance with the requirements of the Regulation (EU) 2016/679 General Data Protection Regulation.

3.4. To the maximum extent permitted by law under no circumstances shall the Promoter or any of its subsidiaries, affiliates, stockholders, directors, officers, employees, licensors or suppliers (the “Promoter Parties”) be liable jointly or severally to any Entrant for any claims or actions of any kind whatsoever, for any indirect, consequential, incidental, special, punitive or exemplary damages or losses to persons or property, including, but not limited to, damages for loss of revenue, profits, use, data or other intangibles, which may be sustained in connection with receipt, ownership and/or use of the Prizes or access to the Prize Draw or any content appearing via the Prize Draw, whether or not characterised in negligence, tort, contract or other theory of liability, and regardless of any failure of an essential purpose of a limited remedy. If any applicable authority holds any portion of this section to be unenforceable, then the liability of the Company Parties shall be limited to the fullest possible extent permitted by applicable law. 3.5. Entrants agree to indemnify, defend and hold harmless the Promoter, its officers, directors, employees, agents, licensors, suppliers and any third party from and against all claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by Entrants.
